  • This Privacy Policy explains how vzw Lootgenot ('we', 'us', 'our') collects, uses, and protects your personal data when you visit dunkfestival.be or purchase tickets for dunk!festival. We are committed to complying with the General Data Protection Regulation (GDPR) and applicable Belgian data protection law.

    2. What Data We Collect

    2.1 Ticket Purchase

    When you purchase a ticket through Ticket Tailor, we collect the following data:

    • First and last name

    • Email address

    • Country of residence (if provided at checkout)

    • Payment reference (handled by Stripe or PayPal — we do not store full payment details)

    • Order history and ticket type

    2.2 Website Visits

    When you visit dunkfestival.be, we may collect the following data depending on your cookie preferences:

    • IP address and browser type (via server logs)

    • Pages visited, time spent, and navigation behavior (analytics cookies, with consent only)

    • Cookie consent choices

    2.3 Newsletter Subscription

    If you subscribe to our newsletter, we collect:

    • Email address

    • Date and source of subscription (e.g. sign-up form or checkout checkbox)

    We only send newsletters to contacts who have explicitly opted in.

    3. Why We Process Your Data (Legal Bases)

    We process your personal data on the following legal bases under the GDPR:

    • Performance of a contract (Art. 6(1)(b)): to process your ticket order and communicate about your attendance.

    • Consent (Art. 6(1)(a)): for newsletter communications and non-essential cookies. You can withdraw consent at any time.

    • Legitimate interest (Art. 6(1)(f)): for fraud prevention, website security, and aggregate analytics used to improve our event.

    • Legal obligation (Art. 6(1)(c)): to comply with Belgian tax and accounting obligations.

    4. Third-Party Processors

    We share your data with the following processors, each bound by appropriate data processing agreements:

    • Ticket Tailor (tickettailor.com) — ticket sales and attendee management

    • Stripe (stripe.com) — payment processing (EU-based processing, SCCs in place for any international transfers)

    • PayPal (paypal.com) — alternative payment processing

    • Email service provider — newsletter distribution (only to opted-in subscribers)

    • Hosting/CDN provider — dunkfestival.be website infrastructure

    We do not sell your personal data to third parties.

    5. Cookies

    Our website uses a cookie consent banner. We distinguish between:

    • Strictly necessary cookies: required for the website to function (e.g. session management, cookie preference storage). These do not require consent.

    • Analytics cookies: used to understand how visitors use our site. These are only placed after you give consent via the cookie banner.

    • Marketing/tracking cookies: we do not currently use these without explicit consent.

    You can update your cookie preferences at any time by clicking 'Cookie Settings' in the footer of our website.

    6. How Long We Keep Your Data

    • Ticket and order data: retained for 7 years to comply with Belgian accounting law (Wetboek van Economisch Recht).

    • Newsletter subscriptions: retained until you unsubscribe. You can unsubscribe via the link in every email.

    • Analytics data: retained in aggregated, anonymized form. Raw session data is deleted after 26 months.

    • Cookie consent logs: retained for 1 year.

    7. Your Rights Under the GDPR

    As a data subject, you have the following rights:

    • Right of access: request a copy of the personal data we hold about you.

    • Right to rectification: request correction of inaccurate data.

    • Right to erasure: request deletion of your data, subject to legal retention obligations.

    • Right to restriction: request that we limit processing of your data.

    • Right to data portability: receive your data in a structured, machine-readable format.

    • Right to object: object to processing based on legitimate interests.

    • Right to withdraw consent: withdraw consent for newsletter or cookies at any time, without affecting the lawfulness of prior processing.

    You also have the right to lodge a complaint with the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit / Autorité de protection des données): www.gegevensbeschermingsautoriteit.be.

    8. Data Security

    We implement appropriate technical and organizational measures to protect your data against unauthorized access, loss, or misuse. Ticket Tailor, Stripe, and PayPal all maintain their own security certifications (including PCI-DSS compliance for payment processors).

    9. Changes to This Privacy Policy

    We may update this Privacy Policy from time to time. The current version is always available at dunkfestival.be. Material changes will be communicated via our website or newsletter.

  • These Terms & Conditions govern the purchase of tickets and attendance at dunk!festival, organized by vzw Lootgenot. By purchasing a ticket, you agree to these terms.

    1. Organizer

    dunk!festival is organized by vzw Lootgenot, based in Zottegem, Belgium. All ticket sales are processed through Ticket Tailor. Payments are handled by Stripe and/or PayPal.

    2. Tickets

    2.1 Purchase

    Tickets are available exclusively through the official ticket shop linked from dunkfestival.be. We cannot guarantee the validity of tickets purchased from third-party resellers.

    2.2 Ticket Validity

    Each ticket is valid for the edition and day(s) stated on the ticket. Tickets are personal and non-transferable for the purpose of fraud prevention, though you may transfer your ticket to another person using the TicketSwap platform (see Section 3). Duplicate or counterfeit tickets will be refused at the gate.

    2.3 Age & Access

    dunk!festival is open to all ages unless otherwise specified for particular areas (e.g. areas where alcohol is served). Minors under 16 must be accompanied by a parent or legal guardian. Valid ID may be requested at the entrance.

    3. Resale

    If you can no longer attend, we encourage you to resell your ticket via TicketSwap (ticketswap.com), a trusted peer-to-peer platform that limits resale prices to the face value of the ticket. Selling tickets for above face value or via unauthorized channels is prohibited and may result in ticket invalidation.

    4. Festival Rules

    By entering the festival grounds, attendees agree to:

    • Follow instructions from organizers, security staff, and stewards at all times.

    • Not bring prohibited items onto the festival grounds. A full list of prohibited items is published on dunkfestival.be ahead of the event.

    • Behave in a respectful and safe manner towards other attendees, artists, and staff.

    • Not record or broadcast performances without prior written consent from the organizer.

    Violation of these rules may result in removal from the festival without refund.

    5. Liability

    vzw Lootgenot is not liable for:

    • Personal injury, loss, or damage to property, except where caused by our gross negligence or willful misconduct.

    • Acts of force majeure (see Section 6 of the Cancellation Policy).

    • The acts or omissions of third-party vendors, artists, or service providers on the festival grounds.

    Attendance at a live music festival involves inherent risks. Attendees are responsible for their own safety and wellbeing.

    6. Intellectual Property

    All festival branding, artwork, photography, and audiovisual content produced by or for dunk!festival remain the property of vzw Lootgenot or the respective rights holders. Unauthorized commercial use is prohibited.

    7. Governing Law

    These Terms & Conditions are governed by Belgian law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Oost-Vlaanderen, afdeling Oudenaarde.

  • This policy sets out the rules for refunds and cancellations in relation to ticket purchases for dunk!festival.

    1. Cancellation by the Attendee

    Tickets are non-refundable once purchased. We do not offer refunds for change of plans, illness, travel disruption, or any other personal circumstance.

    If you can no longer attend, you are encouraged to transfer your ticket to another person via TicketSwap (ticketswap.com). TicketSwap allows peer-to-peer resale up to the face value of the ticket and ensures the validity of both buyer and seller.

    We are not responsible for any failed sales or losses incurred through third-party resale platforms.

    2. Cancellation or Postponement by the Organiser

    2.1 Full Cancellation

    In the unlikely event that dunk!festival is cancelled entirely by vzw Lootgenot (including due to force majeure — see Section 3), ticket holders will be offered a refund of the ticket face value.

    The refund will be processed via the original payment method (Stripe or PayPal) within 30 days of the official cancellation announcement. Service fees charged by Ticket Tailor at the time of purchase may not be refundable, as these are charged by a third-party platform.

    2.2 Postponement

    If the festival is postponed to a new date, all tickets will automatically remain valid for the rescheduled event. Ticket holders who cannot attend the new date will be offered a refund of the ticket face value, provided they request this within 30 days of the postponement announcement.

    2.3 Partial Cancellation

    If specific days or stages are cancelled while the rest of the festival proceeds, no refund will be offered for day tickets to the affected day(s) unless vzw Lootgenot determines otherwise. Multi-day pass holders may be offered a partial credit at the organizer's discretion. Any such decision will be communicated via our website and newsletter.

    3. Force Majeure

    vzw Lootgenot shall not be held liable for cancellation or disruption caused by circumstances beyond our reasonable control, including but not limited to:

    • Natural disasters, extreme weather events, or epidemics

    • Government restrictions, bans on public gatherings, or venue closure orders

    • Strikes, civil unrest, or national emergencies

    • Failure of essential infrastructure (power, water, communications)

    In force majeure situations, we will make every reasonable effort to reschedule and to provide refunds where possible, but cannot guarantee full reimbursement if our own costs cannot be recovered.

    4. How to Request a Refund

    To request a refund in circumstances where one is offered, please contact us via the contact form on dunkfestival.be. Include your order number and the email address used at purchase. Refunds will be processed within 30 days of approval.

    5. Consumer Rights

    Tickets for live events are exempt from the standard 14-day right of withdrawal under Belgian and EU consumer law (Boek VI WER / Directive 2011/83/EU, Art. 16(l)), as they are contracts for leisure activities on a specific date. This exemption is disclosed at the point of purchase.
